Royalty RCM Update 2026: क्या छोटे कारोबार को केवल Royalty के कारण GST Registration लेना जरूरी है?
छोटे Royalty Payment से RCM और फिर पूरी Outward Supply पर Tax Demand—क्या यह सही है?
हाल के दिनों में कई छोटे व्यापारियों, ठेकेदारों और mining lease holders को ऐसे GST notices मिल रहे हैं जिनमें पहले Government को दिए गए छोटे-से royalty या licence fee payment पर Reverse Charge Mechanism (RCM) की मांग की जाती है।
इसके बाद विभाग यह तर्क देता है कि RCM के कारण Section 24 के अंतर्गत GST registration अनिवार्य था। इसलिए संबंधित तारीख से taxpayer की पूरी taxable outward supply पर भी GST देय है।
इस प्रकार ₹50,000 या ₹1,00,000 की royalty entry कभी-कभी कई लाख रुपये की tax, interest और penalty demand में बदल जाती है। लेकिन प्रत्येक मामले में यह approach सही नहीं है।
महत्वपूर्ण निष्कर्ष
यदि Government द्वारा दी गई royalty/mining-right service Notification No. 12/2017–Central Tax (Rate) की Serial No. 7 के अंतर्गत exempt है, तो उस royalty पर RCM payable नहीं होगा। ऐसी exempt royalty के आधार पर अकेले compulsory GST registration और पूरी outward supply पर tax demand बनाना उचित नहीं होना चाहिए।
लेकिन यह blanket exemption नहीं है। इसके लिए preceding financial year का aggregate turnover, applicable registration threshold, business की अन्य activities, supplier की identity और service की exact nature जाँचना आवश्यक है।
यह कोई नई 2026 notification नहीं, बल्कि existing exemption entry का एक महत्वपूर्ण और अक्सर छूट जाने वाला application है।
Royalty पर GST का सामान्य नियम क्या है?
Mining lease या natural resources के उपयोग का अधिकार देने के बदले State Government को दी गई royalty/licence fee को सामान्यतः Government द्वारा दी गई service माना जाता है।
Notification No. 13/2017–Central Tax (Rate) की Entry 5 के अनुसार Central Government, State Government, Union Territory या local authority द्वारा business entity को दी गई specified services पर tax recipient को RCM में देना होता है। Official Notification No. 13/2017–CT (Rate)
GST Council ने भी स्पष्ट किया है कि mineral exploration और mining rights देने की service पर 1 July 2017 से 18% GST लागू माना गया है। 45th GST Council Meeting Recommendations
सामान्य स्थिति में calculation इस प्रकार होगा:

लेकिन RCM notification लागू करने से पहले यह देखना आवश्यक है कि संबंधित service किसी exemption notification से exempt तो नहीं है। यहीं Serial No. 7 महत्वपूर्ण हो जाती है।
Notification No. 12/2017 की Serial No. 7 क्या कहती है?
Serial No. 7 Central Government, State Government, Union Territory या local authority द्वारा उस business entity को दी गई services exempt करती है, जिसका preceding financial year का aggregate turnover उस सीमा तक है, जिससे वह CGST Act के अंतर्गत registration exemption के लिए eligible है।

इसका अर्थ यह है कि केवल royalty की रकम नहीं, बल्कि recipient business का preceding financial year का aggregate turnover और उसकी registration eligibility test की जाएगी।
Entry 7 किन services पर लागू नहीं होती?
Entry 7 में निम्न exclusions दिए गए हैं:
Department of Posts की specified services;
aircraft या vessel से संबंधित specified services;
goods या passengers का transport; और
Government द्वारा immovable property renting की service।
Royalty या mining rights का grant इस exclusion list में expressly शामिल नहीं है। इसलिए facts सही होने पर below-threshold business entity Entry 7 का benefit claim कर सकती है।
Section 24 बनाम Entry 7
CGST Act की Section 24(iii) के अनुसार जिस व्यक्ति को RCM में tax देना आवश्यक है, उसे सामान्य turnover limit के बावजूद compulsory registration लेना पड़ सकता है। CGST Act—Sections 22 to 25
लेकिन provisions को इस क्रम में पढ़ा जाना चाहिए:
सबसे पहले देखें कि Government service taxable है या Entry 7 से exempt।
यदि service exempt है, तो उस supply पर RCM tax payable नहीं है।
यदि RCM tax payable ही नहीं है, तो केवल उसी royalty transaction के कारण Section 24(iii) का compulsory-registration trigger नहीं बनना चाहिए।
इसके बाद outward turnover को सामान्य registration provisions और अन्य compulsory-registration triggers के अनुसार जाँचा जाएगा।
यह निष्कर्ष notifications और Section 24 को साथ पढ़ने से निकलता है। CBIC ने royalty-specific facts पर अलग circular जारी करके इस precise sequence को घोषित नहीं किया है। इसलिए notice reply में facts और documents के साथ reasoned legal submission देना चाहिए।
Aggregate Turnover में Royalty Payment जुड़ेगा क्या?
नहीं। CGST Act की Section 2(6) के अनुसार aggregate turnover में taxable outward supplies, exempt supplies, exports और inter-State supplies शामिल होती हैं।
लेकिन ऐसी inward supplies जिन पर recipient RCM में tax देता है, aggregate turnover में शामिल नहीं होतीं। CGST Act—Definition of Aggregate Turnover
अर्थात ₹1,00,000 की inward royalty को outward turnover में जोड़कर threshold cross नहीं कराया जा सकता।
Applicable Threshold कितना माना जाएगा?
Threshold हर मामले में ₹20 lakh या ₹40 lakh मान लेना सही नहीं है।
सामान्यतः Section 22 के अंतर्गत ₹20 lakh threshold लागू होता है, जबकि कुछ specified States में अलग limit हो सकती है। Exclusive suppliers of goods को Notification No. 10/2019–Central Tax के अधीन, निर्धारित conditions पूरी होने पर, ₹40 lakh तक registration exemption मिल सकती है। CBIC Central Tax Notifications—Notification 10/2019
इसलिए निम्न बातों की जाँच करें:
Business goods supply करता है, services या दोनों;
principal place of business किस State में है;
exclusive-goods ₹40 lakh exemption की सभी conditions पूरी होती हैं या नहीं;
कोई अन्य Section 24 compulsory-registration trigger तो नहीं है;
same PAN की all-India aggregate turnover कितनी है।
Example 1: Below ₹20 Lakh—Royalty RCM Nil
मान लीजिए एक small business entity की preceding FY aggregate turnover ₹17,50,000 थी। उसने current year में State Government को ₹80,000 royalty दी। उसके मामले में कोई अन्य compulsory-registration condition लागू नहीं है।
यदि Entry 7 को नजरअंदाज किया जाए
Royalty RCM:
₹80,000 × 18% = ₹14,400
CGST = ₹7,200
SGST = ₹7,200
Entry 7 लागू होने पर
Preceding FY turnover सामान्य ₹20 lakh threshold से नीचे है। Government royalty service excluded category में नहीं आती और बाकी conditions भी पूरी हैं।
Taxable value under RCM: Nil
RCM payable: Nil
केवल इस royalty के कारण compulsory registration: नहीं
Example 2: Turnover Threshold से ऊपर—RCM Payable
मान लीजिए business services और goods दोनों supply करता है तथा preceding FY aggregate turnover ₹28,00,000 थी। State Government को royalty ₹2,50,000 दी गई।
Business ₹20 lakh threshold से ऊपर है, इसलिए Entry 7 का benefit उपलब्ध नहीं है।
GST Calculation
Royalty RCM = ₹2,50,000 × 18% = ₹45,000
CGST @9% = ₹22,500
SGST @9% = ₹22,500
RCM liability electronic cash ledger से pay करनी होगी। Electronic credit ledger का उपयोग RCM liability चुकाने के लिए नहीं किया जा सकता, क्योंकि CGST Act में “output tax” की definition RCM tax को exclude करती है।
Eligible होने पर ₹45,000 का ITC tax भुगतान के बाद claim किया जा सकता है। CGST Act—Sections 16 and 49
Interest Illustration
मान लें ₹45,000 की RCM liability 300 दिन late pay की गई और applicable interest rate 18% p.a. है:
Interest = ₹45,000 × 18% × 300 ÷ 365 = लगभग ₹6,658
Eligible ITC ₹45,000 हो सकता है, लेकिन interest ₹6,658 का ITC नहीं मिलता। यह business cost रहेगा। Actual interest period और rate notice period के अनुसार verify करें।
पुराने financial years की demand में RCM आज pay करने से ITC automatically सुरक्षित नहीं हो जाता। Self-invoice/tax-paying document, Section 16(4) की time limit और relevant clarifications की अलग जाँच आवश्यक है।
Example 3: Exclusive Supplier of Goods—₹40 Lakh Limit की सावधानी
मान लीजिए Madhya Pradesh में एक mine operator केवल taxable minerals की outward supply करता है। उसकी preceding FY aggregate turnover ₹32,00,000 और royalty ₹1,20,000 है।
यदि वह Notification No. 10/2019–Central Tax की exclusive-goods exemption की सभी conditions पूरी करता है और कोई independent compulsory-registration trigger नहीं है, तो applicable threshold ₹40 lakh हो सकता है।
उस स्थिति में Entry 7 का benefit उपलब्ध होने का मजबूत आधार बन सकता है।
Nominal RCM without exemption:
₹1,20,000 × 18% = ₹21,600
Entry 7 applicable होने पर RCM: Nil
लेकिन ₹40 lakh limit automatic नहीं है। State, product, business activities और Notification 10/2019 की exclusions जाँचे बिना notice reply में ₹40 lakh का दावा न करें।
Example 4: कैसे ₹18,000 की RCM Entry बड़ी Outward Demand बन सकती है?
मान लीजिए royalty transaction financial year की शुरुआत में हुआ और नीचे दी गई पूरी outward supply उसके बाद की गई:
Preceding FY turnover: ₹12,00,000
Current FY outward taxable sales: ₹18,00,000
Government royalty: ₹1,00,000
Outward goods पर assumed GST rate: 5%
Department का संभावित calculation, यदि Entry 7 ignore हो
Royalty RCM:
₹1,00,000 × 18% = ₹18,000
Outward GST:
₹18,00,000 × 5% = ₹90,000
Total basic tax demand = ₹1,08,000, इसके अतिरिक्त interest और penalty।
Entry 7 लागू होने पर संभावित सही परिणाम
Royalty service exempt: RCM Nil
Royalty के कारण Section 24 registration trigger: नहीं
Current outward turnover भी assumed ₹20 lakh threshold से नीचे: outward GST Nil, यदि कोई अन्य registration trigger नहीं है।
इस प्रकार Entry 7 पर आधारित सही legal analysis केवल ₹18,000 RCM demand ही नहीं, उससे जुड़ी ₹90,000 outward-tax demand को भी प्रभावित कर सकता है।
Registered Taxpayer Taxable Royalty RCM कैसे Report करे?
जहाँ exemption उपलब्ध नहीं है और royalty RCM taxable है:
Liability को GSTR-3B की Table 3.1(d)—Inward supplies liable to reverse charge में report करें;
RCM tax cash से pay करें;
eligible ITC को Table 4(A)(3) में claim करें;
royalty challan, lease document, Government demand/order, payment proof और applicable self-invoice/tax-paying document सुरक्षित रखें।

Royalty RCM Notice मिलने पर क्या जाँचें?
Supplier की पहचान: Payment वास्तव में State/Central Government या local authority को है, या किसी contractor/collector को?
Payment की nature: Royalty, licence fee, auction premium, dead rent, DMF/NMET contribution और penalty को बिना analysis एक ही category में न रखें।
Preceding FY turnover: PAN-wise all-India aggregate turnover का प्रमाण तैयार करें।
Applicable threshold: ₹10 lakh, ₹20 lakh या conditional ₹40 lakh—जो वास्तव में लागू हो वही लें।
Other registration triggers: Inter-State taxable supply, casual taxable person, e-commerce या अन्य Section 24 conditions अलग से जाँचें।
Entry 7 exclusions: Government immovable-property rent जैसी excluded service को royalty exemption के साथ mix न करें।
Outward-tax linkage: Notice में royalty RCM से compulsory registration और फिर outward tax demand कैसे निकाली गई है, उसकी legal chain को अलग-अलग challenge करें।
Limitation: Image में Sections 73, 74 और 74A से जुड़े year-wise remedies दिए गए हैं। Limitation एक independent defence है। Relevant FY, annual-return due date, extensions, SCN date और fraud allegation देखकर अलग calculation करें। किसी generic chart को बिना verification सीधे reply में न लगाएँ।
Notice Reply के साथ कौन-से Documents लगाएँ?
Preceding FY और relevant FY की financial statements;
turnover reconciliation, ITR और उपलब्ध GST/VAT records;
mining lease, quarry licence या Government permission;
royalty challans और treasury receipts;
Notification 12/2017 की Entry 7 और applicable amendments;
applicable registration-threshold notification;
PAN-wise declaration कि कोई अन्य turnover या registration trigger है या नहीं;
outward-supply working और department demand का reconciliation;
limitation और absence of fraud/suppression पर अलग legal submission, जहाँ facts support करते हों।
निष्कर्ष
Royalty पर 18% RCM सामान्य नियम हो सकता है, लेकिन हर royalty payment को taxable नहीं मान लिया जाना चाहिए।
Notification No. 12/2017–CT (Rate) की Serial No. 7 below-threshold business entities के लिए एक महत्वपूर्ण exemption प्रदान करती है।
यदि यह exemption लागू है, तो royalty RCM Nil हो सकता है और उसी exempt transaction के आधार पर compulsory registration तथा पूरी outward supply पर tax demand की chain कमजोर पड़ सकती है।
फिर भी relief केवल royalty की छोटी रकम देखकर नहीं मिलेगा। सही defence के लिए preceding FY turnover, applicable threshold, exact payment nature, supplier identity, other registration triggers और limitation—सभी की document-based जाँच जरूरी है।
Practical takeaway: Royalty RCM notice मिलने पर tax जमा करने या demand स्वीकार करने से पहले Entry 7 eligibility की year-wise और document-wise verification करें।
